1. Object

These General Conditions regulate the use (including mere access) of this website of SOCIEDAD GENERAL DE AGUAS DE BARCELONA, S.A. (SGAB), including the contents and services made available, if applicable, thereon. Any person who accesses this website is considered to be a “User” and expressly, automatically and voluntarily agrees to abide by the General Conditions in force each time that they access the aforementioned website and the specific conditions which, if appropriate, are applicable to it.

In any case, SGAB reserves the right to amend unilaterally, at any time and without the need for prior notice, the structure and design of the website, to amend or remove services or contents and the conditions of access and/or use of the website. 

2. Use of the Website

The User is aware and voluntarily and expressly accepts that the use of the website is carried out in any case under their sole and exclusive responsibility.

The user undertakes to use the website and its services and contents without breaching the legislation in force, good faith, general accepted uses and public order. It is likewise forbidden to use the website for illicit purposes or in ways detrimental to SGAB or any third party.

On using the website, the User undertakes not to behave in any way which may damage the image, the interests and/or the rights of SGAB and/or of third parties or which may damage, disable or overload the website, or which prevents, in any way, the normal use of the website.

SGAB adopts reasonably adequate security measures to detect the existence of viruses. However, the User must be aware that the security measures of computer systems on the internet are not entirely reliable and that, therefore, SGAB cannot guarantee the non-existence of viruses or other elements which may cause alterations to the computer systems (software and hardware) of the User or to their electronic documents and files contained therein.

3. Industrial and Intellectual Property Rights

All the industrial and intellectual property rights and all the information contained on the website (images, graphic designs, source code, design, browsing structure, databases, and any other content which appears therein) are the exclusive property of SGAB.

These General Conditions do not assign any Intellectual or Industrial Property Right on the website or on any of its constituent parts (images, graphic designs, source code, design, browsing structure, databases, and any other content which appears therein), the reproduction, transformation, distribution, public communication, making available, extraction, reuse or use of any kind, by any means or procedure, of any of them being expressly forbidden for the User, except in the cases in which it is legally permitted or is authorized expressly and in writing by the holder of the corresponding rights.

The user is solely authorized to view and obtain a temporary private copy of the contents for their exclusive personal and private use on their computer systems (software and hardware) and which are not subsequently transferred to third parties. With the above exceptions, the user may not amend or reproduce, either partly or in its entirety, this information, without the express written consent of SGAB. Without limitation:

1) The user is not authorized to use the information contained on the website for the purpose of developing activities of a commercial or professional nature (direct sale or sale with any other kind of commercial aim or commercialize this information in any way). 
2) The user is not authorized to remove, evade or manipulate the copyright and other data identifying the rights of SGAB, or any protection mechanisms.
3) The user is not authorized to dismantle, decompile or invert the databases on which the information of the website is stored.
4) The user must respect and undertakes not to carry out, directly or indirectly, any action with the aim of evading, breaching, or in any other way rendering ineffective any measure of any nature aimed at protecting the website.

All the information on the website is copyright protected. The unauthorized use of the information contained on this website, its resale, and the infringement of the Intellectual or Industrial Property Rights of SGAB, shall give rise to the legally established responsibilities.

The brands (distinguishing signs and logos) which appear on the website are owned exclusively by SGAB and are duly registered or in the process of registration. The names of other Products, Services and Companies which appear in this document or on the website may be brands or other distinguishing signs registered by their respective and legitimate owners.

4. Exclusion from guarantees and liability

SGAB is not responsible for the damages arising from the use of the contents of its website. In particular, SGAB does not answer for the contents or the state of the links that this website contains, and which may lead the user to other websites and pages managed by third parties. SGAB does not answer for the contents or the state of these websites and pages. Access to them through this website does not imply that SGAB recommends or approves of their contents.
SGAB is not responsible for the deficiencies of the service of its server, or for the communication networks, or for the problems resulting from the incorrect operation or use of non-optimized versions of browsers. 

Both access to the website and the use that may be made of the information contained thereon is the exclusive responsibility of whoever carries this out. SGAB shall not answer for any consequence, damage or prejudice that may arise from this access to or use of the information. SGAB is not responsible for the possible security errors which may occur or for the possible damage that may be caused to the user’s computer system (hardware and software), the files or documents stored thereon, as a result of the presence of viruses in the user’s computer used for the connection to the services and contents of the website, of an incorrect operation of the browser or of the use of non-updated versions thereof.

5. Hyperlinks and Linked Websites

The establishment of a Hyperlink does not under any circumstance imply the existence of relations between SGAB and the owner of the website or page on which the Hyperlink is established, or the acceptance or approval by SGAB of its contents or services.

In any case, SGAB reserves the right to forbid or disable at any time any Hyperlink to its website, especially in the event of cases of the illicit nature of the activity or contents of the website which includes the Hyperlink.

For the purpose of the provisions of this Condition, the website of SGAB makes available to the user, solely to search for, and access, the information, contents and services available on the internet, Hyperlinks or technical link devices (e.g. links or buttons), which allow the User to access internet websites or portals belonging to or managed by third parties (Linked Websites).

SGAB does not offer or commercialize by itself and/or through third parties the information, contents and services available on the Linked Websites, nor does it approve, supervise or control in any way the contents and services or any material of any nature existing thereon, the User exclusively accepting all responsibility for browsing thereon.

6. Applicable law and jurisdiction

These General Conditions of use shall be governed by Spanish law.

SGAB and the user expressly renounce any other jurisdiction which may correspond to them, and shall abide by the jurisdiction of the Courts and Tribunals of the City of Barcelona, for any matters which may arise or actions which may be exercised arising from the provision of the service of the website and of its services and contents and on the interpretation, application, fulfilment or breach of that established herein.
